Geimer asked Judge Scott Gordon to either dismiss the case or sentence the "Chinatown" director to the six weeks he served in prison before he fled the country ahead of his scheduled sentencing in 1978.

Gordon said he would issue a written ruling on the motion.

Geimer also ripped a previous DA who accused her of being out to get money from Polanski, and questioned her integrity.

Since filmmaker Roman Polanski won't return to court to resolve his sexual assault case, his victim is going to stand up for him.

Geimer, 54, has long-forgiven Polanski for having sex with her in 1977 while she was 13, and said that Polanski should be sentenced in absentia to time served in part to end the scrutiny she has faced in the case.

Polanski, 83, is now wanted by United States authorities over the rape, which took place in 1977.

The director, writer and producer, who won an Oscar in 2002 for "The Pianist" fled to his native France in 1978 before his sentencing and still lives in Europe.

Asked what a fair manner would be, she said: "You'll find that out when I'm done talking (in court)". That hearing was in relation to his sexual assault of then 13-year-old Samantha Geimer and Polanski fled, after learning that the judge in the case had declined to honor a plea agreement.

The hearing Friday was part of an effort by defense attorney Harland Braun to unseal testimony by the now-retired prosecutor in the case, who is believed to have testified in a closed session about backroom sentencing discussions.

He admitted statutory rape after a number of more serious charges were dropped, and spent 48 days in custody to undergo psychiatric evaluation before being released. Her letter to the DA, however, did not persuade him to drop the almost 40-year-old ongoing case.

Polanski's case has been a cause celebre for 40 years.

Polanski, whose films include Rosemary's Baby and The Pianist, was arrested on United States warrants in both Poland and Switzerland during the past decade, but both countries ultimately declined to extradite him.

"The people implore this court to deny defendant's motions and to summarily deny any future request to re-litigate these issues absent a showing of new facts or a change in circumstance", Hanisee wrote.

Geimer also played down the severity of what happened to her, saying Polanski had apologised and that they had exchanged emails in recent years. Nicholson was not home at the time.

While most sex abuse victims are criticizing the government for stronger sentencing in an effort to curb the number of incidents and to feel vindicated in their specific cases, Geimer is taking the opposite approach.

A lawyer for Polanski says his sex crime victim, Samantha Geimer, will appeal to a Los Angeles judge on Friday, June 9, 2017, to help make the case that Polanski has served his time for the 40-year-old crime.
