Cosby trial alternate juror: I would have voted to convict”

On Saturday, Judge Steven O'Niell of Norristown, Pennsylvania declared a mistrial in the trial of USA actor Bill Cosby for sexual assault because the jury had become deadlocked, unable to arrive at a unanimous guilty or not guilty verdict.

McCloskey, who posted photos of his Montgomery County, Pennsylvania, juror's badge on Facebook to authenticate his claim, told WDVE radio that he was "ridiculously sick" when a mistrial was declared after the jury said it was "hopelessly deadlocked" on three counts of aggravated indecent assault.

Constand, 44, of Toronto, accused the aging comedian of drugging and molesting her at his home near Philadelphia in 2004, when she worked at his alma mater, Temple University. Cosby's trial ended without a verdict after jurors failed to reach a unanimous decision.

News outlets will ask Judge Steven O'Neill at a hearing Tuesday afternoon to release the jurors' names.

Jurors can reveal they were on the jury. Constand then sued Cosby in civil court and the matter was settled with an undisclosed sum.

McCloskey and the five other alternates did not participate in the 52 hours of deliberations that eventually left the 12-person jury hung and were kept separate from the panel. Because they fully intend to attempt to re-prosecute Cosby, prosecutors are fighting tooth and nail to keep the identities of the jurors in the first trial hidden.

McCloskey did not immediately return a message Monday.

McCloskey, who said he did not want to be selected because he feared jury service would prevent him from watching Pittsburgh Penguins hockey games, said he and other alternates were segregated from the rest of the jury during deliberations.

O'Neill may have concern that naming them publicly could lead to another spate of stories on what led to the jury room logjam, further affecting potential jurors' thoughts on the case.

He said the jurors were completely mum on what caused the mistrial on the bus ride back to the hotel near the Norristown courthouse.

His publicists read a letter from Cosby's wife, Camille, on the courthouse steps after the trial that attacked O'Neill as "arrogant" and District Attorney Kevin Steele as "heinous" and "ambitious".

Countless women came forward against Cosby, saying that he also drugged and assaulted them.

The AP does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
