Federal Judges Uphold Ruling To Overturn Brendan Dassey Conviction”

A United States federal appeals court yesterday overturned the conviction of Brendan Dassey, one of two men charged in the case depicted on the Netflix series Making a Murderer. He had told investigators that he had helped his uncle Steven Avery rape and kill the photographer in the family's scrap yard in Manitowoc County, Wisconsin.

US Magistrate Judge William Duffin overturned Dassey's conviction in August, citing his age, intellectual deficit and lack of guardian during questioning.

A three-judge panel of the Seventh Circuit Court of Appeals in Chicago ruled 2-1 to uphold a federal judge's ruling previous year that overturned Dassey's conviction for a 2005 murder.

The original ruling was upheld by a three-judge panel, Dassey's lawyer Laura Nirider confirmed to ABC News.

Johnny Koremenos, a spokesman for Wisconsin Attorney General Brad Schimel, said the office expects to seek review by the full 7th Circuit or the US Supreme Court, and hopes "that today's erroneous decision will be reversed".

The investigation and trial of Dassey and Avery were chronicled in the popular 2015 Netflix docu-series Making a Murderer, part of wave of multi-part true-crime documentaries that emerged around the time. The then 16-year-old did not have an attorney or his parents present during questioning. But, in September of the same year, prosecutors made an appeal to the ruling that made the order overthrown.

April 25, 2007: After 4½ hours of deliberation, the jury convicts Dassey of being party to first-degree intentional homicide, mutilation of a corpse and second-degree sexual assault.

His uncle was also sentenced to life in a separate trial. Dassey's confession to sheriff's investigators was the key evidence in the trials of both defendants.

According to reports, Zellner insists that Hillegas and Halbach saw each other on October 30, 2005, the day of Halbach's death.

Yet, on Thursday, two out of the three judges made a decision to uphold Duffin's ruling, which overturned Dassey's sentence for his involvement in the assault and murder of Halbach.

We are evaluating the 2-1 decision from the court. They now have 90 days from the court's order to retry him, and state attorneys could also appeal the case to the U.S. Supreme Court.

The state has 90 days to retry Dassey.
