The court chose to take up the case even though the Trump administration urged the justices not to hear Christie's appeal. The Thoroughbred Horsemen's Association's case made much of the same arguments.

At issue is a 1992 law that banned sports betting in all but four states, Delaware, Montana, Nevada and Oregon.

The U.S. Supreme Court on Tuesday said it will hear a case over a federal law that prohibits states from legalizing sports betting, a surprise decision that could send leagues running to Congress for a solution.

The US Supreme Court was expected to reveal whether it would grant the state's petition in its ongoing effort to legalize sports wagering within its borders on Monday morning. The Supreme Court didn't take an appeal from the state in 2014. The Atlantic City casinos have been hurt by the proliferation of gaming in the Mid-Atlantic states-Pennsylvania in particular-and Monmouth is having a hard time competing against tracks with purses that are fueled by casino and slot profits. New Jersey voters passed a referendum to allow sports betting in 2011.

The cert petition argues the case could have implications on the power of the states to authorize private conduct now banned by state law, including recreational use of marijuana, carrying concealed firearms and working on Sundays.

If for some reason the court decides it doesn't need to address that issue, Gemignani said, it could also decide not to hear New Jersey's appeal.

"People are already betting on sports across the country", said Joe Asher, the CEO of William Hill, which has multiple Nevada locations. One possible scenario is that the court fully repeals PASPA, which could make sports betting legal at places other than just racetracks and casinos.

Issue: Whether a federal statute that prohibits modification of state-law prohibitions on private conduct impermissibly commandeers the regulatory power of states in contravention of NY v.
