"Common sense, for instance, dictates that close family members be defined to include grandparents", U.S. District Judge Derrick Watson said in his ruling.

A federal court in Hawaii dealt a new blow to President Donald Trump's Muslim ban late Thursday evening, lifting a controversial policy that prevented certain close relatives of US residents from entering the country, while also paving the way for many refugees to elude the ban. Under the Supreme Court's order, persons subject to Trump's Muslim ban could still enter the United States, but only if they "have a credible claim of a bona fide relationship with a person or entity in the United States".

Watson could rule this week.

The government filed court documents Tuesday opposing Hawaii's latest motion, saying the state is merely repackaging a previously rejected clarification request. "Indeed grandparents are the epitome of close family members". Hawaii, though, had argued that the federal government's interpretation of the Supreme Court's ruling - which exempted those with a "bona fide relationship" with people or entities in the U.S. from being banned - was too narrow. Chin's brief cites a Ukrainian granddaughter attempting to reunite with her 93-year-old grandmother, a refugee stranded in Malawi while his uncle waits for him here, and "countless individuals" promised resettlement by a dedicated refugee organization.

Rosenberg may be conflating the portion of Watson's injunction that protects refugees, which the Supreme Court left intact, with the injunction against the 120-day ban on immigrants from six Muslim-majority countries, which the Supreme Court overturned.

"Because plaintiffs now seek such injunctive relief, the court reaches the merits of their request, consistent with the Ninth Circuit's guidance", Watson wrote.
