CBI seeks NBW against Gurung”

Central Bureau of Investigation (CBI) on Monday urged the chief judge of City Sessions Court to issue a non-bailable warrant against Gorkha Janmukti Morcha chief Bimal Gurung and 21 others in the murder case of Akhil Bharatiya Gorkha League (ABGL) leader Madan Tamang. Those accused who were absent in the court made written prayer before the court seeking to be represented by their lawyers. "We have also filed a Special Leave Petition in the Supreme Court to shift the case outside West Bengal" stated Sayan Dey, Defence Counsel. The counsel for GJM leaders also appealed to the court for protection of party leaders and activists living at Gorkha Bhavan in Kolkata and alleged they were being harassed regularly. The Chief Judge directed the Commissioner of Bidhannagar City Police to file an affidavit in Court regarding this.

The Calcutta High court on Wednesday asked the 23 accused in the 2010 murder of Akhil Bharatiya Gorkha League leader Madan Tamang to remain present in the city sessions court as the latter takes up the framing of charges. Apart from Bimal Gurung, senior GJM leaders Asha Gurung, Roshan Giri, Binay Tamang and Devendra Sharma were among those who were absent. They however failed to turn up. Out of the total 54 accused, four have died while two are absconding. Most of the accused against whom the CBI wanted arrest warrants are now spearheading a movement for carving out a separate state for the Nepali-speaking community of West Bengal's Darjeeling district.

A division bench presided over by acting Chief Justice Nishita Mhatre had directed the trial court to hold day-to-day hearing and conclude framing of charges by August 17. Gurung, who is spearheading the agitation for a separate state, is underground in the Hills. The indefinite bandh clamped from June 15 is part of the agitation.

Amidst Darjeeling unrest, pressure increases on Bimal Gurung. The case was handed over to the CBI. His wife Bharati Tamang had lodged a FIR accusing Bimal Gurung of ordering the killing. 22, including Gurung, Giri, Tamang had moved anticipatory bail pleas in the Calcutta high court.
