Republicans have long protested the payments, and in late 2014 the GOP-led House filed a federal lawsuit against the Obama administration, contending that the subsidies were unconstitutional because Congress had not made a specific appropriation for them.

White House officials said Mr. Trump would make a decision on whether to continue the payments this week, yet it hasn't happened yet.

To account for the risk that the administration could pull the plug on CSRs, many states instructed insurers to submit two sets of rate requests.

The judges also reasoned that states could be harmed if the cost-sharing payments were cut off because increased insurance prices could translate into more uninsured residents for whom the states needed to provide health care, including at public hospitals. But Senate Health Committee Lamar Alexander said he will push for bipartisan efforts to stabilize the individual insurance markets when lawmakers return in September, as exchange customers in 20 counties across Nevada, Indiana and OH face the prospect of having no choices at all next year.

But some conservatives are still fuming about the GOP's failure to dismantle Obamacare after seven years of campaign promises to kill the 2010 law. It added that the states had shown that they deserved an opportunity either to try to persuade the government to keep up the subsidies, or to compel it to do so.

Most recently, after the Senate failed to pass any Obamacare repeal or replacement legislation, President Trump Tweeted that, "If a new HealthCare Bill is not approved quickly, BAILOUTS for Insurance Companies and BAILOUTS for Members of Congress will end very soon!" Ted Cruz, Texas Republican, told reporters Wednesday.
