Monica Thompson, 42, argues that she was still "groggy" from her C-section three days before her son Jacob was placed in her care at Portland Adventist Medical Center in OR on August 2, 2012.

A woman in OR filed a lawsuit against the hospital where she gave birth after her son died from being smothered at four days old.

Thompson describes feeling "still drowsy and groggy" from her medication at the time. The suit says Thompson called for a nurse, and when none came, she "carried her son to the hallway and frantically yelled for help". The lawsuit also claims the Portland hospital nurse brought the newborn in to breastfeed at 3 a.m. and put him into the bed with Thompson before exiting and leaving them unattended. Her suit alleges that the death was preventable and that she should have never been left alone in her condition with the newborn child.

Four days earlier, on August 2, 2012, the then 42 year old Thompson had given birth to a healthy boy via C-section, with the boy taken to a nursery three days later so his mother could recover.

Seven days later, the baby died.

The baby suffered brain damage, and had to be taken off life support at 10 days old after doctors diagnosed that he would not improve from his comatose state. The newborn suffocated under his mother after she fell asleep while nursing him. "His inability to breath caused him desperation and anxiety", the lawsuit states. "His pulse was weak or absent".

Ms Thompson claims the hospital has "directly caused her severe emotional distress, severe depression, post-traumatic stress disorder, severe anxiety and prolonged grief disorder".

The lawsuit filed on behalf of both Monica Thompson and baby Jacob also stated the newborn may have been subjected to substantial pain when his ribs were broken while CPR was being administered at the Portland Adventist Medical Center.

"The hospital staff was totally irresponsible for giving the mother Vicodin AND Ambien at the same time", wrote one Daily Mail reader. "Malpractice at its best". "I don't believe it's 100% the hospital's fault, when nurse brings your baby, you can always refuse and tell them to place the infant in their crib that is next to your bed". "But their biggest hope is that other hospitals don't do this and it can set clear policies for their nurses to avoid something as senseless as dropping off a child for breastfeeding to a mom loaded with narcotics and painkillers". "There is also a button next to you, which you can just press to alert the nurse you need immediate assistance, so if she was too exhausted to breastfeed before falling asleep, she could've called the nurse".
