Surrogacy bill: House panel trashed the proposed legislation”

On November 21, 2016, the Surrogacy (Regulation) Bill, 2016 was introduced in Lok Sabha and referred to the standing committee by the Chairman, Rajya Sabha in consultation with the Speaker, Lok Sabha on January 12, 2017.

The ART Bill was drafted in 2008, and underwent frequent reviews and re-drafting first in 2010 and later in 2014.

The Bill aimed at proper regulation and supervision of ART clinics and banks and prevention of misuse of this technology including surrogacy.

"The committee fails to comprehend the reasons behind bringing a fresh Bill specifically on surrogacy, when a detailed, comprehensive and all encompassing Bill on ART services had already been drafted by the department".

These provisions have been denounced by the House panel, chaired by the Samajwadi Party member Ram Gopal Yadav.

While clearing the Bill in August 2016, External Affairs Minister Sushma Swaraj had said that couples who are "medically unfit to have children" can seek help from a close relative, which is called altruistic surrogacy.

"Appropriate modifications be incorporated in the said clause and other relevant clauses of the Bill with a view to harmonise the Bill with the compensated surrogacy model", reads the report.

On women from poor socio-economic background taking up surrogacy as a means of livelihood, the committee said, "Economic opportunities available to surrogates through surrogacy services should not be dismissed in a paternalistic manner".

The committee noted that permitting women to provide reproductive labour but not paying them for the same was unfair and biased. Expecting a woman, that too, a close relative to be altruistic enough to become a surrogate and endure all hardships of the surrogacy procedure in the pregnancy period and post partum period is tantamount to another form of exploitation.

The committee also objected to the bill restricting surrogacy to legally married couples, claiming it overlooks a large section of society like widows, divorced women and live-in couples. "The bill is not in consonance with the present day social milieu that we live in and is too narrow in it's approach", the report notes. If all these categories are to be banned then why have surrogacy at all.

Making those who wish to opt for a surrogate wait for at least five years plausibly violated the right to reproductive autonomy and an individual's right to exercise choice, the committee added.
