Supreme Court asks government for detailed reply on deportation of Rohingyas”

The junior Home Minister said global organisations have been harsh on the Central government for stating that Rohingyas - a minority Muslim community in Myanmar who are fleeing the country after being caught in violent ethnic clashes - would be deported from India.

"India must respect the various Conventions and treaties that provide a framework for refugee protection and extend such protection to the Rohingya refugees in India", the petitioners said, seeking the court to order the Centre not to deport them and also provide basic amenities as required by global law in treatment of refugees.

The petition against their deportation was filed with the Supreme Court by two Rohingyas - Mohammad Sallimullah and Mohammad Shakir.

Rijiju said that India will not use force for deportation, rather will follow legal procedures.

An advisory issued by the Home Ministry has asked all state governments and Union territories to identify Rohingyas while indicating that they could pose grave security challenges.

It has also sought a direction that Rohingyas be provided "basic amenities to ensure that they can live in human conditions as required by worldwide law".

The government has been threatening to deport all of them.

The plea also stated that "this act (deportation) would also be in contradiction with the Principle of Non-Refoulement, which has been widely recognized as a principle of Customary International Law". "They are illegal immigrants in India", Rijiju told reporters here.

The Principle of Non-Refoulement prohibits states from sending back refugees to a country where their life may be in danger. "In fact, no other country has accepted as much refugees as India", he said.

The SC is slated to hear the matter next on 11 September. We already have enough (immigrants). Nagaland and Sikkim are ruled by parties belonging to the NEDA. That also applies equally to Rohingyas who have settled in different parts of the country, including Jammu and Kashmir.
