Mumbai: Patanjali Ayurved's product advertisements appear to be hitting a legal hurdle from several quarters. However, customers across India and overseas continued to put their faith in Patanjali and its products which helped the firm achieve its magnificent feat this year.

The Delhi High Court has restrained Patanjali from airing advertisements to promote its "Chyawanprash" till September 26 after rival brand Dabur complained in the court, saying Patanjali commercial disparaged its product. The advertisement urges people to reject "chemical-based soaps" and adopt natural ones. The division bench of Delhi HC has restrained the telecast and circulation of Patanjali's said advertisement. Justice KR Shriram passed the order after fixing the matter for hearing once it was mentioned by plaintiff's lawyers.

The bench said, Patanjali can not broadcast its advertisement till the next hearing on September 26. The ads had made fun of products such as Pears, Lifebuoy, Dove and Lux.

The ad, while talking about Patanjali's ayurvedic products, had disparaged HUL's soap brands, prompting the latter to approach the court.

Reckitt Benckiser has secured an "ad interim injunction" from the Delhi HC against Patanjali.

Dabur submitted that the "trade dress/packaging" for its product had acquired distinctiveness as the consumer at large, particularly those who may not be literate, may recall the features of the "Dabur Chyawanprash".

When contacted, a Dabur India spokesperson confirmed that the Delhi HC has granted ad-interim injunction to the advertisement.

According to Dabur, Patanjali's trademark and the style of packing in the advertisements is too similar to Dabur's and any unsuspecting customer can easily be fooled. "Undoubtedly, grave and irreparable loss and damage would ensue to the appellant if interim protection is not granted".
