On Wednesday, nine mostly former employees filed a lawsuit in L.A. Superior Court against the restaurant, Biel, and her business partners, for allegedly denying the plaintiffs meal and rest breaks, and withholding "tens of thousands of dollars in gratuities from major Hollywood parties they worked for companies like Netflix, Amazon and Fox", according to the Hollywood Reporter. It also describes the staffers as "young adults new to the workforce and new to Los Angeles" who "were unfamiliar with workers' rights and were ill-prepared to deal with violations of their rights in the workplace".

Jessica Biel and her restaurant business partners allegedly collected almost half a million dollars in gratuities from their private events, but never passed along that money to their employees, who have now filed a massive lawsuit.

In former Au Fudge Director of Events Alexandra Desage's deposition, she claimed that "every private event customer" she interacted with during her time at the restaurant was under the impression that the gratuity would go directly to the people that had actually worked the event, as is customary in the restaurant industry.

According to court documents, obtained by the Blast, Au Fudge charged a 22 per cent gratuity to clients who held private events at the West Hollywood eatery - but employees say that money was never passed down to them. They have a son named Silas together.

We reached out to Au Fudge for comment and were directed to contact Au Fudge partner and fellow defendant Jonathan Rollo, who did not immediately respond to a request for comment. Don't worry about it'.

Desage says in the suit that she approached one of the partners, Rollo, on several occasions to question the restaurant's policies on gratuities but was told "don't worry about it" leaving her with a feeling that "he was blowing me off and knowingly burying his head in the sand".

Another employee, Jamie Aronson, said a general manager once let slip that "the customers are far more likely to be OK with 20-plus percent if they think that amount is going to the employees", according to The Blast.

When Desage, who is not a plaintiff in the suit, brought this to the attention of management, she was brushed off.

They are also seeking an additional $1,000,000 in punitive damages.

The restaurant was opened in March 2016 and sells itself as a restaurant friendly to both parents and their kids.
