Student sues OH university to play football this season”

Pearson will hear arguments at 3 U.S. District Court concerning whether Ma'lik Richmond should be allowed to play in this weekend's Youngstown State University football game. Another hearing is set for September 28, when Richmond's permanent status on the team could be determined.

A hearing is scheduled for Thursday afternoon at the federal courthouse in Youngstown.

Richmond's attorneys argued that not allowing him to play could hurt future prospects of an National Football League career.

YSU President Jim Tressel was not present. Richmond is asking for reinstatement to the team's active roster, attorney fees and an unspecified amount of damages.

A student petition sought to remove Richmond from the team based on his sexual assault conviction while he was a high school student in Steubenville. He served one year in a juvenile detention facility for his crime.

It was a controversial, highly publicized case that was initially discovered because of a cell phone recording from a party that went viral.

The complaint filed by Richmond claims he did not violate the student code of conduct and was denied due process in violation of the 14th Amendment.

No good deed goes unpunished. Youngstown State University has been hauled into court by a student that YSU has bent over backward to assist, support and provide a second chance when no one else would.
