Lawyer Says Administration Considering Extending DACA Renewal Deadline”

Martin Batalla Vidal speaks outside Brooklyn federal court, where a judge encouraged the Justice Department and Department of Homeland Security to extend a deadline for DACA recipients.

Garaufis, a Democratic appointee who previously expressed dismay about Trump's travel ban, is hearing a suit brought by a DACA recipient over the Obama administration's rules that is being refiled as a class action challenging Trump, and he has also been assigned a challenge from NY and other states.

"Hours after President Trump lavished praise on so-called Dreamers, a federal judge questioned the Department of Homeland Security in Brooklyn Thursday about the deadline looming for the thousands of immigrants brought into the United States illegally when they were children to renew their status - or be deported". "I believe DHS would be well served by giving that process the chance to bear fruit".

"No one will be harmed by extending this deadline", Garaufis said, "especially the 800,000 people who are sweating about whether someone is going to come knocking on their door and send them back to a country that they don't even know and where they don't speak the language".

The parties were in court to discuss a planned class action challenging the Trump administration's decision to wind down Deferred Action for Childhood Arrivals. And he repeatedly challenged Deputy Assistant Attorney General Brett Shumate to persuade the government to extend an October 5 deadline for DACA recipients to renew their applications.

U.S. District Judge Nicholas Garaufis is overseeing a case in which immigration advocates want to challenge President Donald Trump's decision to end a program that has protected some young immigrants from deportation. But Garaufis, who scoffed at what he described as the arbitrariness of the deadline, urged them to reconsider. Chuck Schumer announcing what they called a deal to save DACA in exchange for increased border security, according to the Associated Press.

Trump said on Thursday he was close to a deal with Democratic congressional leaders on protections for Dreamers, astounding fellow Republicans while alarming conservative supporters.

Garaufis, who's scheduled to hear the DACA suit against the Trump administration brought by Eric Schneiderman and 15 other attorneys general, also said that he'd prefer to see the issue hammered out in the legislature rather than by a judge.

Lawyers from the Justice Department and Make The Road will reconvene September 26 to present arguments and decide on the status of the reapplication deadlines, which the plaintiffs said they would challenge in court if the government does not extend them.

"He knows that if we lose DACA and we lose our jobs, that will cause a lot of harm to our families", Batalla Vidal told reporters after the hearing.
