Kenya's Supreme Court explains why it nullified presidential polls”

Kenya's Supreme Court said Wednesday that it nullified President Uhuru Kenyatta's re-election largely because the electoral commission refused to allow an investigation of its computerized system that transmitted results.

The court ordered the election commission to hold a new election by the end of October, and the commission chose Oct. 17 as the new date.

"A coup in Kenya has just been done by the four people in the Supreme Court", said Kenyatta, adding, "We have reversed everything in this country by the decision of a few people". It also said that some forms lacked security features such as watermarks, signatures or serial numbers, which calls their authenticity into question.

"The IEBC failed to conduct election in simple, accurate, credible, verifiable and accountable manner, " the DCJ said. "We are unable to validate the result". "We do not need to look far for examples".

Mr Odinga had been referring to the spat between the President and Chief Justice David Maraga who heads the Supreme Court team of judges that annulled the presidential election results.

Justice Philomena Mwilu was one of three justices to explain why she voted in favor of the petition, filed by Raila Odinga's opposition coalition, which challenged incumbent President Uhuru Kenyatta's win.

While announcing the date, IEBC chairman Wafula Chebukati said the decision was taken to ensure the commission is adequately prepared in light of the court's full judgment delivered on Wednesday. "Such acts are not only unlawful but savage in nature".

However, the Supreme Court fell short of finding any specific individual culpable for any of the illegalities and technicalities committed during the electronic transmission of the presidential election results.

"If anomalies remain, the same court will annul the elections regardless of the aspirants", he said.

Meanwhile, ruling party supporters protested outside the court demanding the judges' removal. Clashes killed around 1,200 people following a disputed 2007 presidential vote.

Nairobi was tense this week ahead of the ruling, with police tear-gassing protesters and the U.S. embassy urging calm.

Yesterday a group of opposition supporters arrived as the judges continued to read their verdict and kept dancing and celebrating outside the court for hours as police watched from a distance.

Should the commission fail to organise an acceptable new poll, Kenya will face a constitutional crisis.

Addressing the nation from State House Nairobi, Mr Kenyatta said the apex court failed to consider evidence that was presented his lawyers and those representing the Independent Electoral and Boundaries Commission.
