Uber vs. London, Round Two: Tribunal Weighs Whether Drivers Are Contractors

Uber vs. London, Round Two: Tribunal Weighs Whether Drivers Are Contractors”

"Uber drivers have more control and are totally free to choose if, when and where they drive with no shifts or minimum hours", he said.

Uber's response to TfL's ban has so far been uncharacteristically contrite, with new CEO Dara Khosrowshahi apologizing for the "mistakes we've made"-mistakes that occurred under the watch of his predecessor, the combative Travis Kalanick".

The hearing at the central London employment appeal tribunal is scheduled to last two days.

"You can't have it both ways: on the one hand acting in an aggressive manner for all sorts of things but on the other hand brief to journalists that they want to do a deal with TfL", he said, adding companies that played by the rules were welcome in London.

"Once we understand them we can work with them to figure out what is it that they would like us to do and how can we move forward and I think that's the important next step", Jones told BBC radio.

Uber has always been a target of complaints from taxi drivers and companies.

Uber drivers are now paid for each ride and are considered self-employed which means they are not entitled to benefits including paid holidays. In the October decision, the judges criticized Uber for sticking to "faintly ridiculous" arguments that it is an application provider rather than a taxi service.

Transport for London (TfL), the local regulator, moved against Uber because it was not "fit and proper" to run private-hire auto services in the capital.

However, riders won't receive instant feedback after a driver selects one of these options - well, aside from the average rating change they might notice. In the USA, drivers have repeatedly sued Uber over their status as contractors.

The taxi app company is appealing against a ruling that its drivers should be treated as workers - entitled to a range of benefits - as opposed to self-employed contractors. The only difference is Uber's app allows that same model to be significantly scaled up, she said.

The suit, being bought by GMB trade union on behalf of the woman, claims that the company fails to provide sufficient security to female drivers, whose ability to work may be affected as a result, lawyers said Tuesday in an emailed statement. "Uber London Limited can continue to operate until any appeal processes have been exhausted". Private hire operators must meet rigorous regulations, and demonstrate to TfL that they do so, in order to operate.

That Uber was "disruptive of traditional business, such as black cabs" was "politically controversial" but also "irrelevant" to the case, she argued.

Last week, London regulators vowed not to renew Uber's license, citing what it said were failures in corporate governance, including in areas such as driver background checks and reporting serious crimes.
