A group that represents nursing homes and assisted living facilities is challenging Florida Gov. Rick Scott's order to install generators at the facilities by December 1, saying the deadline is impossible to meet and the order is simply a reaction to one incompetent nursing home where 11 people died in sweltering heat after Hurricane Irma. The emergency action also requires SNFs to submit their new generators to inspections by fire marshals, and provide local officials with detailed disaster plans.

"Thus the Emergency Rules can not be meant to address an emergency created by the current hurricane season", it said.

In a separate statement, LeadingAge Florida President Steve Bahmer said the group is willing to work with the governor on eventually meeting the directive. Hollywood Hills, meanwhile, said it notified the Governor's Office in a series of phone calls as soon as the air conditioning went out.

Both the Hollywood police and the Florida Department of Law Enforcement have launched a criminal investigation into the deaths and the State Agency for Health Care Administration revoked the facility's license and shut the home down earlier this month. "They are committed to signing the checks to get this done and to meet the spirit of what the Governor is after".

A new lawsuit-surely only the first of what may become many lawsuits to be filed resulting from the recent deaths of 11 elderly patients at a Florida nursing home in the wake of Hurricane Irma-points to what can happen when regulation fails to protect the vulnerable or when the regulations in place are insufficiently enforced.

"The emergency rules can not be meant to address an emergency created by the current hurricane season in Florida, as the rules are not enforceable until after the hurricane season has ended, and the next season will not begin for more than six months", the petition reads. "We believe that it's the right thing to do", he said.

Other industry groups in the state, he said, may file legal challenges to the rule, too. "We're working with legislators now on that effort".

"We fully support what the governor is trying to achieve with the rule".
