Appeals Court Set to Hear Ezekiel Elliott's Case”

A federal appeals court in New Orleans on Monday afternoon is set to hear arguments on the six-game suspension of Dallas Cowboys running back Ezekiel Elliott.

The two sides squared off in the 5th U.S. Circuit Court of Appeals in New Orleans. The NFL is also scheduled to file a response brief by tomorrow.

The NFL is seeking a stay of the injunction that is keeping the Dallas Cowboys running back on the field.

Judge Elrod in particular pushed the NFLPA on the issue of jurisdiction.

"At the time the petition was filed, the rulings of the arbitrator that were challenged under the fundamental fairness doctrine were definitive, final, and binding, all procedures and remedies had been exhausted, and there was nothing left for the NFLPA to do except brace for the imminent award", Elliott's attorneys wrote. However, the National Football League is hoping to expedite the process so that Elliott is forced to serve the suspension during the 2017 season.

The NFL argues that Elliott and NFLPA are trying to manipulate the system by using the courts to prevent players from serving their suspensions.

The NFL is trying to get the judges to lift a preliminary injunction that Judge Amos Mazzant in Sherman granted Elliott last month allowing him to play. The last time that was the case (prior to Week 1), the National Football League made an agreement to let Elliott play in the following week's game regardless of any decision that came later in the week.

The NFL says if the court doesn't allow them to suspend Elliott now it sends a message that players won't be punished for serious incidents like domestic violence.

The Cowboys are hopeful Elliott will be able to play Sunday against the Green Bay Packers but will be ready to adjust if necessary.

Elliott, the league's leading rusher last season, was suspended for six games on August 11 for violating the league's personal conduct policy stemming from domestic violence allegations made by a former girlfriend.
