Ezekiel Elliott lost the pivotal court battle that he needed on Thursday, as Louisiana's 5th Circuit Court of Appeals ruled the jurisdiction of his lawsuit and injunction against the NFL's six-game suspension for violating the league's domestic violence policy are both invalid.

But due to the collective bargaining agreement, the National Football League believes it doesn't need a conviction to punish a player. The Cowboys are on bye for Week 6. They next play October 22 at San Francisco.

Although Elliott is not yet suspended again - technically speaking - such a decision from the 5th Circuit Court of Appeals certainly clears the way for the Cowboys rusher to be forced back to the sideline.

A three-judge panel heard arguments on the case on October 2.

Three years ago, the National Football League stiffened its domestic violence policy with the six-game standard and more investigative power.

The league concluded after a lengthy investigation that Elliott was guilty of violence in a series of incidents previous year involving his former girlfriend.

The NFL previously prevailed at the appellate level in cases involving Adrian Peterson and Tom Brady in which the NFLPA challenged disciplinary measures and scored victories at the district court level.

Elliott was not present at that hearing.
