SC agrees to examine plea seeking to regulate app-based taxi services”

The Supreme Court has asked the Centre how app-based transport services like Uber, Ola, and redBus can be regulated.

A bench of Justices Madan B Lokur and Deepak Gupta agreed to examine the plea for setting up of a regulatory mechanism for internet-based service providers after it was alleged that some of the companies are foreign-based and were not willing to come within the jurisdiction of Indian courts.

The Bench made a decision to take up the issue after its amicus curiae and senior advocate Indira Jaising pointed to incidents of sexual harassment faced by women passengers from taxi drivers.

She said recently Uber was banned from plying in London as they had refused to subject themselves to the jurisdiction of the local courts. She added that these companies did not have headquarters in India and hence, it was hard to hold them accountable for crimes committed by their drivers. Just the driver or also the company that provided his services? "It is very hard to hold them accountable for any crime committed by their drivers", Jaising said.

It asked NALSA to set up a committee to prepare model rules for victim compensation for sexual abuse and acid attack victims.

"The Chairperson or the nominee of the Chairperson of the National Commission for Women should be associated with the Committee".

The apex court observed that model rules so framed should have uniformity and not generalised on case-to-case basis.

The court was responding to a petition seeking compensation for rape victims.

The courts have asked a similar question earlier.

Jaising is amicus to the court in a case relating to grant of compensation to rape victims under the Nirbhaya scheme.

Lawmakers also echoed the same concern and stressed on the need for proper background checks to ensure the safety of women.
