SC to pronounce order on ban on women's entry in Sabarimala temple”

The Supreme Court on Friday referred to its constitution bench the matter pertaining to a ban on the entry of women at Kerala's Sabarimala temple.

Among the questions referred to the bench include the question of whether or not any group of people - women in this case - can be prevented from entering a Hindu place of worship according to current laws. The observation is in response to the Public Interest Litigation (PIL) challenging the ban on women's entry into the temple. The UDF Government has taken the view that since time immemorial it is followed that the women of ages between 10 and 50 were restricted to enter the historic Sabarimala temple.

In January 2016, the Supreme Court had challenged the ban saying that restriction on women from entering the temple can not be done under the Constitution and in February 2017, it reserved its order. The case has been listed for judgement under Chief Justice of India Dipak Misra and Justices R Banumathi and Ashok Bhushan. "The temple can not prohibit entry (of women), except on the basis of religion".

The apex Court also raised six questions on the issue to be considered by the Constitution bench, reports mentioned.

On November 7 past year, the Kerala Government has announced in the court the women of all ages are permitted inside the historic Sabarimala temple.

The petition assailing the above Rule and seeking lifting of ban on entry of women was filed by Indian Young Lawyers Association more than a decade ago - in 2006. It said that this can not be done under the Constitution. Venogopal told the court that it was a question of religious diversity and mentioned the name of Attukal Bhagavathy Temple in Kerala where men are not allowed.

In 2014, the Congress-led government said there was a "mistake" in its own submissions to court earlier and that women can not be permitted in the temple because of the deity's celibacy vows.

Women's rights activists have high hopes from the apex court. So Women should be permitted inside the Sabarimala temple. "I am sure the judgment will also be very positive and landmark", she was quoted as saying. This violates the rights of the women.
