SALT LAKE CITY - A Utah police detective has formally appealed the decision to fire him after he was caught on video roughly handcuffing a nurse because she refused to allow him to draw blood from an unconscious patient, his lawyer said Friday.

"You demonstrated extremely poor professional judgment (especially for an officer with 27 years of experience), which calls into question your ability to effectively serve the public and the department", Brown wrote.

Payne's supervisor, Lt. James Tracy, was demoted to officer.

Attorney Greg Skordas, who represents Payne, has said his client served the department well for almost three decades and questioned whether his behavior warranted termination.

Payne acted on orders from Tracy, who arrived later.

But Tracy was the catalyst, the police chief said, because he had ordered Payne to arrest the nurse for interfering with a police investigation "without fully understanding the nature of the situation".

Brown also criticized Tracy and said his lack of judgment was "unacceptable" and "as a result, I no longer believe that you can retain a leadership position in the Department".

SLCPD Chief Mike Brown was given the final decision regarding Payne's employment, and terminated him earlier this week.

Wubbels and her lawyer released the video at a September 1 news conference because they felt the police were not taking the matter seriously enough. In preparation for the hearing, Skordas is also asking for "any correspondence" between Brown and Biskupski regarding Payne's firing, and a copy of the Salt Lake City Police Department's blood draw policies that were in place the day Wubbels was arrested.

The incident was sparked by the case of an off-duty Idaho reserve police officer whose vehicle was struck by another motorist fleeing the police in a pickup truck.

On July 26, Payne was sent to University Hospital to collect blood from a man injured in a crash that killed the driver who caused it. Salt Lake City police apologized and changed their policies.

Payne had previously been disciplined in 2013 after internal-affairs investigators confirmed that he sexually harassed a female co-worker in a "persistent and severe" way.

Payne, a Utah police officer who was caught on video roughly handcuffing a nurse because she refused to allow a blood draw was sacked Tuesday, Oct. 10, 2017, in a case that became a flashpoint in the ongoing national conversation about police use of force.
