VirnetX Wins Big Patent Case Against Apple

While this is the final judgement from the US District Court the case is being argued in, Apple tells The Verge that it plans to appeal the ruling - continuing this long-running patent battle, which began back in 2012.

The latest judgment of almost $440 million not only confirms a $1.20 jury award per infringing product but includes interest, attorney fees and inflated royalties of $1.80 for periods of willful infringement.

The case involves a bit of legal hocus-pocus, as the four patents that Apple was accused and found liable of violating have already been ruled invalid by the U.S. Patent and Trademark Office more than a year ago. The total now sits at $439.7 million. If Apple has better luck in court, VirnetX won't get a second shot - and it can't wield those patents in new lawsuits regardless of what happens with Apple. The firm announced on Monday that it was awarded $439.7 million in its case against Apple over patents it claims Apple used for iMessage and FaceTime. The judgment, filed on September 29, means Apple is on the hook for $439.7 million in damages, patent holding and security software company VirnetX said in a statement Monday. "We believe this established per device rate for security is very reasonable and will greatly assist us with our domestic and global licensing efforts".

At time of publication, VirnetX was trading up 3.5 percent at $7.35.

Other companies that have lost cases to VirnetX - which is sometimes referred to as a patent troll for the fact that it's most often in the news because of these suits - include Microsoft (which ultimately paid around $200 million to the company).
