U.S. District Judge Theodore Chuang granted a nationwide preliminary injunction late Tuesday, after U.S. District Judge Derrick Watson in Hawaii blocked the revised ban. Each new sequel tends to get more implausible with time with the appearance of previously killed villains (think "Terminator"), new "celestial" fathers (think "Guardians"), or previously destroyed evil organizations (think "Avengers").

Previous iterations of the ban targeted six Muslim-majority countries, but were checked by the Supreme Court. Watson's order, issued in response to a lawsuit filed jointly by the state of Hawaii, a Honolulu-based mosque, its imam and two state residents who have relatives in the affected countries, prevents the government from enforcing the new restrictions on travel from all of the nations except North Korea and Venezuela. (Chuang hasn't ruled yet, and even if he sides with the government, Watson's injunction will still apply until it's directly overturned by a higher court.) It prohibits the administration from enforcing the ban against people who can not prove they have a "bona fide" - or good faith - relationship with USA persons or entities, such as businesses or universities.

"We will continue to fight back every step of the way until this recalcitrant White House drops their fixation on implementing a ban that fails to uphold fundamental American values, undermines the core values that built this country and does more harm than help the national security of the United States", said Menendez, D-N.J., a senior member of the Senate Foreign Relations Committee, which Booker also sits on. The new opinions in Hawaii and Maryland offer basically the same narrative while ignoring the new factual foundation. He noted that the new version still "lacks sufficient findings that the entry of more than 150 million nationals from six specified countries would be 'detrimental to the interests of the United States, '" and that it "plainly discriminates based on nationality in the manner that the Ninth Circuit has found antithetical to both Section 1152 (a) and the founding principles of this Nation". "And like the two before it, this one is going down to defeat in the courts".

Chuang seems to place a heavy burden on the administration to "prove the negative", or, in this case "prove you are not anti-Muslim".

Government lawyers said in court filings in Hawaii and Maryland that Trump's travel order falls within his presidential powers and was written after an extensive review of vetting procedures for nations around the world.

That order was put on hold by Judge Watson the day before it was supposed to go into effect; the Ninth Circuit agreed with Watson that the order was likely unconstitutional, and the Fourth Circuit, in a separate (narrower) case, sided against the administration as well.
