Trump's Third Travel Ban Blocked By A Second Federal Judge”

The travel restrictions were to apply to citizens of Iran, North Korea, Syria, Yemen, Chad, Libya and Somalia and some Venezuelan officials and their relatives.

Judge Watson said the new travel ban ignores the ruling by the Court of Appeals for the Ninth Circuit that stated previous orders exceeded the scope of President Trump's authority and promoted discrimination based on nationality. His ruling said the latest version discriminates based on nationality.

Neal Katyal, one of the lawyers on the case, tweeted "We just won" in the wake of this move.

For good measure, Watson pointed out all the times Trump has launched Twitter tirades about his travel ban.

Previous iterations of the ban targeted six Muslim-majority countries, but were checked by the Supreme Court.

The president's third order has numerous features of prior versions, especially the second one, but it is significantly different in that the restrictions would be made permanently. Others questioned why Chad, a staunch US ally, was added to the list. The president has maintained his push for a travel ban has been motivated by a desire to protect the USA from terrorism.

Chuang blocked the administration only from enforcing the directive on those with a "bona fide" relationship with a person or entity in the United States, such as family members or some type of professional or other engagement in the United States.

The latest ban has been the third of its kind Trump has issued since taking office.

The fundamental question of this lawsuit is the same as the last ones: Is a ban on entries from certain Muslim-majority countries a discriminatory "Muslim ban", or a legitimate national security act?

Based on the history of the last seven months of litigation over Executive Order 13780, the Department of Justice can be expected to appeal Watson's ruling to the Ninth Circuit and, presumably, eventually to the Supreme Court.

"These restrictions are vital to ensuring that foreign nations comply with the minimum security standards required for the integrity of our immigration system and the security of our nation", White House Press Secretary Sarah Huckabee Sanders said.

Watson is also responsible for tossing a few gallons of cold water on the travel ban once it was allowed to go forward.

Plaintiffs include Ismail Elshikh, an American citizen of Egyptian descent, and two others who have not been identified by name - one a naturalized US citizen born in Yemen and a resident of Hawaii for almost 30 years, the other a lawful permanent resident of the USA born in Iran and working as a professor at the University of Hawaii.

On Monday, for example, Chin joined a coalition of 15 attorneys general in filing an amicus brief opposing the administration's plans to ban open military service by transgender individuals.

"As long as the government tries to enact the same core policy over and over again, it should not be surprised that it ends up with the same result over and over again, which is courts finding these bans to be illegal and unconstitutional", Jadwat said in a phone call. As such, the court actually allowed much of the order to be executed. Those statements, according to the courts in San Francisco and Richmond, Virginia, betrayed an anti-Muslim animus behind the executive orders.

Watson was a 2013 nominee of President Barack Obama, a Democrat.
