We Just Fully Blocked Muslim Ban 3.0!

We Just Fully Blocked Muslim Ban 3.0!”

Though Judge Chuang of Maryland and Judge Derrick K. Watson of Hawaii both ruled to block the travel ban, they ruled against it for slightly different reasons.

President Trump's Twitter account landed him into trouble yet again Wednesday, with a federal judge using a recent tweet about shooting terrorists with bullets dipped in pigs' blood to prove Mr. Trump still maintains "religious animus" toward Muslims - and therefore his latest travel ban is illegal.

After federal judges blocked the president's earlier executive orders, Trump tweeted that the ban should be larger and tougher. If the administration was able to tailor "to what the national security community has said are actual risks", she said Trump's team might "fare better" in court. The prohibition against travellers from North Korea and Venezuela will still go into effect.

White House Press Secretary Sarah Huckabee Sanders says the Hawaii decision "undercuts the president's efforts to keep the American people safe and enforce minimum security standards for entry into the United States". That's a "precondition" Trump again failed to satisfy, Watson said, in part because the new travel ban "contains internal incoherencies" that have nothing to do with national security.

The Trump campaign listed the proposal as an official policy, calling for a "total and complete shutdown of Muslims entering the United States until our country's representatives can figure out what is going on". Rather the bans on both those countries will affect relatively tiny groups compared to the banned Muslim-majority nations. The directive was met with protests at airports and several legal challenges before the president signed a revised version on March 6, according to Fox News.

Previous travel bans issued by the Trump administration have also been caught up in the courts. On Tuesday, a federal judge in Hawaii - the same one Jeff Sessions once derided as a "judge on an island in the Pacific" - dealt the president yet another setback in his bid to impose travel restrictions on a number of nations, a lot of them Muslim-majority. It targeted about 150 million potential travelers from Chad, Iran, Libya, North Korea, Somalia, Syria and Yemen, along with some Venezuelan government officials and their families.

Unlike the previous temporary bans, this one was created to be permanent.

In ruling temporarily for the challengers, the judge rejected the claims by Administration lawyers that the challenge was premature because none of those involved in the lawsuit had yet been denied an entry visa, and that the courts simply had no authority to decide the challenge, at least so far as it was based on federal immigration laws. The Justice Department said it will appeal and Attorney General Jeff Sessions defended the ban as an important tool to fight terrorism. Finally, as the Maryland and Hawaii courts explained, it adopts nationality-based discrimination for people seeking green cards, even though Congress has specifically banned that discrimination. The Hawaii ruling came in a case brought by that state, while the Maryland ruling came in cases brought by relatives of travelers who would be blocked; the International Refugee Assistance Project; and organizations that invite scholars and others from the affected countries to participate in conferences.

"Today is another victory for the rule of law", Chin said. And as long as it does, we and our partners will keep fighting to defend our friends, neighbors, colleagues, and visitors of every religion and to preserve the promise of the Constitution.
