Police in IL have filed premeditated murder charges against a 55-year-old man accused of killing and then dismembering his mother, whose remains were discovered in duffel bags in a Chicago lagoon, PEOPLE confirms.

Days later, prosecutors say the 55-year-old admitted to stomping on his mother and killing her on October 25 after they got into a fight.

According to police, Brian Peck, from IL, reported his 76-year-old mother Gail missing on Friday, allegedly telling detectives she went for a walk and never returned, PEOPLE reports. "The defendant is 6'1" and 260 pounds, and the victim was 5'4" and 140 pounds", said assistant state's attorney Maria McCarthy.

A court official tells PEOPLE Peck is alleged to have withdrawn $500 from his mother's checking account on October 25; investigators allegedly recovered video footage of the ATM transaction.

The (Arlington Heights) Daily Herald reports that DuPage County records show Gail Peck filed an order of protection against her son in March 2016.

Prosecutors say Brian Peck then chopped up his mother in the bathtub, bought cleaning supplies, tarps, brick pavers and luggage and canceled his cleaning lady.

The following day, authorities contend he allegedly transferred $4,000 from his mother's savings account into her checking account.

But when officers received information Gail's death may have been "criminal in nature", authorities searched the Peck home where they allegedly found blood stains and then a body in a nearby lagoon, which was confirmed to belong to Gail Peck.

Among the items discovered in the lagoon Saturday were a duffle bag with two severed legs and a hand saw from the Lincoln Park Rowing Lagoon, and a suitcase containing a female torso severed at the upper thighs.

That's when prosecutors say Brian Peck revealed that two days before he reported her missing, his mother called him to her room because she was "furious" that he was playing Jimi Hendrix music so loud. Once there, she told him she wanted him to leave.

Prosecutors allege Peck returned to Walmart on October 26 to buy luggage, a duffel bag, and a steam cleaner.

Peck allegedly confessed to the killing under questioning on Tuesday, a court official tells PEOPLE.

Peck was later detained by police and is being held without bail.

Brian Peck was ordered held without bail Tuesday as a judge called him "an extreme threat to the public".

His next court hearing is November 17.
