Canadian actress sues Weinstein for two alleged sexual assaults”

Deadline is reporting that an anonymous Canadian actress-model has initiated a lawsuit that includes Disney regarding Harvey Weinstein.

Paz de la Huerta is the latest to level allegations of sexual assault against disgraced movie producer Harvey Weinstein.

The plaintiff is seeking a total of Can$14 million (US$11 million).

None of the allegations have been proven in court. Unsurprisingly, Barbara (who is now an executive with The Weinstein Company) has also been named in the lawsuit. Disney has been listed as a co-defendant in this case as they owned Weinstein's Miramax at the time of the alleged incident.

"To be clear, not a single woman has accused Robert Weinstein of sexual assault or rape - let alone of decades of predatory sexual behavior", the company's attorney wrote in their court filing.

Thinking that this was the opportunity of a lifetime, the actress agreed to the meeting.

You won't be shocked to learn that Weinstein did not call her back to the hotel to apologize.

The woman, who submitted the lawsuit under the name Jane Doe, says that the now-disgraced Hollywood executive "pushed her onto the bed, and took his penis out of his trousers ... forced down her skirt and held her down by her wrists", according to the Toronto Sun.

"He said words to the effect of 'I do think you are a very talented young girl but the best thing you could do for your career.' He then gestured and looked at his penis", the document alleged.

The suit says Weinstein then "forced down her skirt and held her down by her wrists".

The producer then allegedly forcibly performed oral sex on the woman without her consent, the document said. Since then, dozens of other women have claimed Weinstein was sexually inappropriate with them, while 13 are saying he raped them. When he loosened his grip, she managed to get one of her hands free, push his face away and bolt for the hotel room door.

The actress was then allegedly assaulted again, the proposed statement of claim said.

Doe's suit says that when she stepped into the doorway, Weinstein "threw his weight onto her and tried to stick his tongue down her throat".

Doe eventually broke free, however, when she ran into the assistant in the lobby, Schneeweiss merely "looked down".

Weinstein repeatedly called the woman from time to time for about a year to ask for further meetings and to "otherwise harass her", but she refused to see him again, the document said.

According to the Toronto Sun, the unnamed accuser has taken the first step in launching a lawsuit as she has filed a statement of claim.

The civil case will be in a Toronto court on November 6, where the woman's lawyers will be seeking to move ahead with the claim without using her name. She may not continue with the case if she must use her name, the affidavit said.

More than 60 women have accused Weinstein of sexual harassment and assault since October 5.

Weinstein was sacked from TWC last month after allegations of sexual harassment and assault were published in a New York Times exposé.
