Trump's Voter Fraud Commission Is Being Sued by One of Its Commissioners”

Maine Secretary of State Matthew Dunlap announced Thursday he is suing President Trump's Advisory Committee on Election Integrity, a committee on which he sits.

A leading Democrat on President Donald Trump's voter fraud commission is suing the group, which is led by Kansas Secretary of State Kris Kobach, alleging that it has violated federal law and that he has been frozen out from meaningful activities and information.

The commission has met twice since its inception via an executive order from Trump, who has claimed, without proof, that millions of illegally cast ballots cost him the popular vote in the election he won against Hillary Clinton a year ago Tuesday.

The panel was charged by Mr. Trump with investigating the prevalence of voter fraud, voting roll problems and barriers to voting.

Pence and others have pledged that the commission has no preordained agenda as it looks at voting practices that could undermine or bolster confidence in elections.

According the Thursday's complaint, Kossack, in his response to Dunlap's inquiries, refused to confirm that the commission's operations were on hold, nor did he respond substantively to Dunlap's requests for more information.

Seven Republicans and four Democrats are on the panel.

"In fact, the Commission's superficial bipartisanship has been a facade", Dunlap says in the suit.

"The Commission has, in effect, not been balanced because Secretary Dunlap and the other Democratic commissioners have been excluded from the Commission's work".

The commission has been targeted in at least eight other lawsuits seeking to curb its operations or make its deliberations more transparent.

Dunlap also alleged that since the commission's first meeting in July, the communications he's received about the commission have been limited to a few emails about logistical issues. "By obstructing certain commissioners' access to information and failing to allow substantive participation of commissioners with balance in terms of points of view, the Commission and its staff have compromised the legitimacy of any findings that may emerge from this process". The Kansas Republican also is running for governor.

"Since the September 12 meeting, I have received no correspondence from the commission other than to acknowledge receipt of my information request", Dunlap said in a statement.

According to the press release, Dunlap's suit is based on the 1999 Washington, D.C. federal Circuit Court decision in Cummock v. Gore, in which the court held that commissioners may not be denied access to information.

The panel was rattled last month by the arrest of a staff member on charges of possessing child pornography.
