Senate Orders Ndume To Resume Wednesday Following Court Order

The Senate on Tuesday agreed that Senator Ali Ndume can resume duties tomorrow, Wednesday, November 15, after a 90-day suspension.

Announcing resumption, the Deputy Senate President, Senator Ike Ekweremadu, said Ndume should resume plenary session on Wednesday.

A Federal High Court last week, ordered Ndume's immediate reinstatement and payment of all his entitlements for the period of the suspension.

The Borno APC senator was placed on suspension following the recommendation of the ethics and privileges committee of the Senate headed by Chris Anyanwu which accused him of raising a false alarm capable of tarnishing the image of his colleagues.

Unconfirmed reports on Monday said that Ndume may not be allowed to resume sitting because he is in court with the Senate over his suspension.

In March, the upper legislative chamber gave Ndume a six-month suspension for allegedly embarrassing Senate President Bukola Saraki and Dino Melaye, senator representing Kogi west.

The appellant is further praying the appellate court to dismiss Ndume's suit.

Senate had said it would appeal the Federal High Court judgement which ruled in Ndume's favour on Friday, 10th November, 2017.

The appellants in the notice of appeal filed on their behalf by Mike Ozekhome (SAN), is contending among other grounds, that Justice Quadri erred in law when he held that the right to fair hearing as provided for under Section 36 of the 1999 Constitution as altered inures to the respondent against the appellants who are neither courts nor tribunals established by law.

"That the Plaintiff wrongly joined several causes of action in his Originating Summons".

"The Senate's argument was supported by various and current decisions of the apex court".

The Senate expressed optimism that the decision of the trial court would be overturned by the Court of Appeal.

However, the Senate through its counsel, Mike Ozekhome, said on Sunday that it would appeal the ruling. An application for a stay of execution of the orders of the court will also be filed same time, " Ozokhome stated.
