Fortis dengue matter: Haryana govt finds hospital guilty of criminal negligence”

The committee set up by the Haryana government to probe allegations against a Gurgaon- based private hospital for overcharging the family of a 7- year-old girl, who died of dengue, is likely to submit its report tomorrow, Health Minister Anil Vij said.

The committee has alleged several irregularities, including refusal of appropriate ambulance service to the patient, not following leave against medical advice (LAMA) protocol, and overcharging. The child was on ventilator, but she was shoved in an ordinary ambulance.

The hospital had earlier refuted the charge, claiming the patient's family was informed about the bill on a daily basis and that there was no medical negligence.

"The ambulance in which the girl was being transported had no such facilities. Ventilator was taken off and even the ambubag was not provided that eventually led to child's death, which is a very serious irregularity", Vij said while talking to the mediapersons in his office at Civil Secretariat here today.

The hospital group, in a statement, said, "In reference to the recent media reports on a four-member government inquiry committee pertaining to the unfortunate death of baby Adya, we are yet to receive a copy of the said report". "When the parents demanded that they wanted to take her to another hospital, they were not provided the advanced life-support-system ambulance". The patient is unaware; patient's parents don't know the consequences.

- It is unethical for the doctor to stop the assisted ventilation without handing over to other specialist or directing the relative to ventilate the child by means of ambu-bag. "We shall also be inquiring into it".

Vij said that as per the rules, hospital has to provide information related to dengue patient to the local civil hospital, but the Fortis Hospital has ignored this. He added that a notice has already been given to the hospital for cancellation of blood bank there. "Concealment of this fact can invite punishment ranging from one month to six months and fine from Rs 200 to Rs 1,000", he said.

The health department has also written to Haryana Urban Development Authority (HUDA), which provided the land to hospital on concessional rates, seeking termination of hospital's lease. Probe panel has found that the hospital was not fully adhering to these terms and conditions, which is a violation of MoU.
