European Union sues member states over migrant relocation failure”

The European Commission said Thursday it would take Hungary, Poland and the Czech Republic to the European Court of Justice (ECJ) over their refusal to host asylum seekers.

By pursuing these countries in the EU's top court, Brussels is showing its determination to see this scheme carried out.

According to the Commission, Poland and Hungary haven't taken in any refugees since September 2015, when European Union member states pledged to relocate a total of 160,000 migrants from overstretched Greece and Italy within two years.

If the member state still refuses to comply, the Commission may then decide to refer the case to the Court of Justice.

There was no immediate reaction from Prague, Budapest or Warsaw, but all three have previously said the quotas are part of attempts by Brussels to limit national sovereignty.

Orban has been locked in a series of running battles with the European Union, where Western states and the Brussels-based executive Commission decry what they see as his authoritarian leanings, the squeezing of the opposition and the free media.

Budapest faced a triple legal whammy from Brussels on December 7, with the European Commission also taking Hungary to the ECJ over a crackdown on education and foreign-backed civil society groups that critics say targets U.S. billionaire George Soros.

The Commission has made a decision to start legal proceedings against Hungary for failing to fulfil its obligations under the Treaty provisions on the free movement of capital, due to provisions in the NGO Law which indirectly discriminate and disproportionately restrict donations from overseas to civil society organisations These provisions, which apply by reference to the foreign source of the capital, place a number of administrative formalities and burdens on the recipient of capital and are liable to have a stigmatising effect on both recipients and donors. On 26 April, the Commission chose to take legal action and sent a letter of formal notice to the Hungarian Government on the Hungarian Higher Education Law.

Last month the ECJ warned Warsaw to stop logging in one of Europe's last primeval forests "immediately" or face fines of up to 100,000 euros a day.

The so-called Article 7 procedure would shame Orban by denouncing his government as undemocratic and could even lead to the maximum - though practically highly unlikely - sanction of stripping Hungary of its voting rights in the EU.
