The new policy reflects growing legal pressure on the issue and the hard hurdles the federal government would have to cross to enforce President Donald Trump's demand to ban transgender individuals from the military.

Maj. David Eastburn said the enlistment of transgender recruits will start January 1 and go on amid the legal battles.

The Trump administration must accept transgender recruits into the military by January 1, a federal judge ruled Monday.

And though Trump cited "tremendous medical costs" as a reason for his decision to implement the ban, which prohibited the military for paying for gender reassignment surgery, the Pentagon announced last month that it had approved surgery for an active-duty service member at a private hospital, and that the procedure would be covered by the Pentagon-provided health insurance.

United States Transgender troops will be allowed to serve in the U.S. military from January 1 after a judge blocked an attempt by the Trump administration to ban them.

Trump caused confusion and outrage after he tweeted in July that his administration would make sure that transgender individuals would be barred from serving in the military "in any capacity".

The Department of Justice said in a statement Monday night that "we disagree with the Court's ruling and are seeking to stay the Defense Department's obligations under that ruling as we evaluate next steps". Other studies say that number may be as high as 15,000.

The Pentagon will allow transgender people to join its ranks, it announced Monday, after a judge's ruling.

Since then the Pentagon has shown little enthusiasm for the ban, and transgender troops were told that they could serve until the defence department decided how to implement it.
