James Vlahakis, an attorney representing the plaintiffs in the Chicago lawsuit, said he has been contacted by more iPhone users who say they suffered the same problem and is considering amending the lawsuit to include a request for Apple to provide battery replacements or offer refunds to consumers who purchased devices unnecessarily. Rather than having a phone shut down automatically to protect itself, Apple said that past year it tweaked its iOS software for some older iPhones so they slow down instead.

On Thursday, the company admitted slowing down outdated iPhone devices with low-capacity batteries, saying it is a way of protecting the devices' components.

Apple said lithium-ion batteries become unable to meet its handsets' peak power demands over time, raising the risk of unexpected shutdowns during periods of high demand on the processor.

Stefan Bogdanovich and Dakota Speas have filed suit in the US District Court for the Central District of California, accusing Apple of intentionally slowing down older devices to promote the sale of newer models.

"While this state is created to mask a deficiency in battery power, users may believe that the slow down is due to CPU performance, instead of battery performance, which is triggering an Apple introduced CPU slow-down", Poole wrote.

A separate lawsuit filed by five customers who live in Illinois, Ohio, Indiana and North Carolina, alleges that the tech giant "purposefully neglected to explain that the slowdowns in older model device performance and resulting lost or diminished operating performance could be remedied by replacing the batteries of these devices".

"We think they could have extended the phones' life if (Apple) had been more honest", he said.
