The parents of an 11-year-old girl battling leukemia are suing their IL school district to allow their daughter to take medical marijuana at school.

A federal judge heard from all parties Friday morning and approved a temporary agreement to allow Ashley to receive medical cannabis at her school.

Friday a federal judge ordered Ashley should be allowed to have the medical marijuana as prescribed at school for the seizures. "It hasn't caught up with reality".

While medical marijuana is legal in IL, it is against the law for students to use it in school or have school nurses administer it.

The suit claims that the state's ban on taking the drug at school is unconstitutional because it denies the right to due process and violates the Individuals With Disabilities Education Act and the Americans with Disabilities Act.

Maureen Surin's daughter, Ashley, suffers from seizures that are the complications of her leukemia treatment. For months previous year, Ashley had to use a wheel chair after hitting her head during a particularly bad seizure. The cannabis, combined with a special diet, are helping Ashley lead a better life, according to her mother. Late previous year, a physician prescribed a ketogenic (high fat, low carbohydrate) diet and medical marijuana for Ashley-what her parents say is proving to be a "golden cure".

The lawsuit points out the patch is occasionally ineffective in controlling her seizures.

"Her brain used to be in a cloud", Surin tells reporters. "And now she can think clearer and she's more alert. She is more aware of her surroundings". Superintendent Andy DuRoss says School District 54 will abide by the law.

Kriha credited Ashley's family for pressing her case and the state's attorney general's office for showing flexibility.

At least one other state has addressed the issue legislatively. The district would not accommodate them, the suit said.

Now, the pre-teen can return to school after weeks away. The law prohibits smoking the drug in school, but allows patches or tinctures, as long as it's not disruptive to classrooms.
