Supreme Court to hear sales tax collection case”

The Supreme Court agreed Friday to reconsider one of the most contentious issues in the business world: whether online retailers must collect sales taxes. This represents an opportunity for the Supreme Court to issue much-needed guidance on this issue while reasserting necessary limits on state taxing authority.

South Dakota passed a law two years ago with the intention of overturning the ruling by demanding retailers with more than $100,000 in annual sales pay a 4.5 percent tax on all sales.

Similar legislation was introduced past year with bipartisan support, but the effort has stalled in Congress because House Judiciary Committee Chairman Bob GoodlatteRobert (Bob) William GoodlatteRosenstein to testify before House Judiciary Committee next week Conservative pressure on Sessions grows Clock ticking down on NSA surveillance powers MORE (R-Va.) has wanted to take a different approach on the issue.

States and counties told the court they lose between $13 billion and $34 billion each year because they can not collect sales taxes on all online purchases.

But many states are now ignoring the Quill decision, and absent the Court's action-or legislation from Congress-this will result in a complex and indefensible patchwork of laws harming interstate commerce. North Dakota. That decision was "questionable even when decided", and is "now inflicting extreme harm and unfairness on the states", Kennedy wrote in a concurring opinion.

Gorsuch, the newest Supreme Court justice, suggested skepticism about Quill as an appeals court judge.

"The Court's decision to grant South Dakota's petition is an important signal for retailers that invest in storefronts and jobs in local communities", said Deborah White, general counsel and retail litigation center president for the Retail Industry Leaders Association.

The justices also said they will review several legislative districts in Texas to decide whether they were drawn to dilute the voting power of Latinos.
