ICE Directive OKs Courthouse Arrests Of Immigrants

ICE Directive OKs Courthouse Arrests Of Immigrants”

"HSI's worksite enforcement strategy is focused on protecting jobs for US citizens and others who are lawfully employed, eliminating unfair competitive advantages for companies that hire an illegal workforce, and strengthening public safety and national security". Arrests should also generally be avoided in areas of courthouses that are dedicated to noncriminal proceedings, the policy says.

HSI uses a three-prong approach to conduct worksite enforcement: compliance, through I-9 inspections, civil fines and referrals for debarment; enforcement, through the criminal arrest of employers and administrative arrest of unauthorized workers; and outreach, through the ICE Mutual Agreement between Government and Employers, or IMAGE program, to instill a culture of compliance and accountability.

He also said local law enforcement did not know what type of operation it was.

The outspoken ICE chief said sanctuary locales that refuse to cooperate with immigration agents are effectively "bankrolling criminal organizations" that traffic in guns, drugs and human beings.

The directive said that courthouse screening for "weapons and other contraband" can reduce the safety risks to the public and ICE officers and agents.

Formalizing this courthouse policy confirms what immigrant advocates have already seen anecdotally nationwide since President Donald Trump took office last January. Trump gave federal immigration agents wide discretion to pursue undocumented immigrants. The advocacy group Immigrant Defense Project (IDP) reported a "significant escalation" in the number of ICE courthouse arrests in NY state courts soon after Trump took office.

"ICE will continue to stalk and arrest survivors of violence, young people and people with serious mental illness, just as they have been for the past year", the statement reads. "It makes sense to arrest a criminal in a criminal courthouse". However, judges and critics of the policy predict that it will cause victims, witnesses, and family members to stay away from the courts.

In February 2017, two federal immigration agents entered an El Paso County Courthouse to arrest an undocumented transgender woman seeking a protective order from her allegedly abusive partner. Her alleged abuser reported tipped off ICE. ICE to start tracking license plates across US The notices alerted business owners that agents would be auditing their hiring records to make sure they are complying with the law.

The arrest in El Paso resulted in a "chilling effect" on crime reporting by immigrants.

Torres remains in ICE custody as his immigration case proceeds, the spokesman said. One third of survey respondents reported seeing ICE agents or ICE vehicles in and around courts.

When asked what the Rapid Response Network is telling immigrants who are terrified to go to work, Garcia said, "it would be easier to advise them if the threat weren't so real". "In more recent iterations, the Supreme Court has recognized that the Constitution requires that "access to the courts is adequate, effective and meaningful".
