Immigrants sue White House over end to protected status program

Immigrants sue White House over end to protected status program”

The lawsuit expected to be filed in federal district court in California March 12 challenges the Department of Homeland Security's termination of TPS for nationals of El Salvador, Haiti, Nicaragua, and Sudan.

The coalition of 19 attorneys general from throughout the country asked Congress to protect people who have lived in the USA for a long time and were recipients of Temporary Protected Status, or TPS.

Iván Espinoza-Madrigal, executive director of the lawyers' committee, points to previous comments from President Trump, including equating Latino immigrants with rapists and referring to Haiti as a "shithole" country.

"Long-time New Yorkers from Haiti and El Salvador enrich our economy and strengthen our communities", Schneiderman said in a statement.

Earlier this year, the Trump administration announced that it would terminate Temporary Protected Status (TPS) for approximately 260,000 Salvadorans who live in the US. "If the Trump administration refuses to protect these families, then we need Congress to act".

The NAACP has also filed a separate lawsuit in Maryland on behalf of Haitian immigrants, who received TPS.

The DHS doesn't comment on pending litigation as a matter of policy, agency spokesman Tyler Houlton told Bloomberg Law March 12. The Trump administration says Salvadoran TPS holders have until September 9, 2019, to leave the USA or make arrangements for another legal status before they become eligible for deportation. In the case of Haiti, citizens were allowed to enter the United States following the 2010 natural disaster that killed more than 200 000 people in the French-speaking Caribbean Community (CARICOM) country.

Patricia Montes, executive director of Centro Presente, says numerous plaintiffs in the suit have been living in the country for decades.

Gov. Charlie Baker, a Republican, has expressed his support for extending TPS for Haitians, Salvadorans and Hondurans.

The latest lawsuit, filed by the ACLU Foundation of Southern California, the National Day Laborer Organizing Network, and the Sidley Austin law firm, makes the same argument, but it also claims the decision violates the constitutional rights of USA citizen children by forcing them to live without their parents or leave the country.
