"Got surrounded by the police for being Black in a White neighborhood", Prendergast wrote in an Instagram post. Prendergrast begins to argue that the neighbor wouldn't have called police if they were white, but the officer dismisses her claim.

"They have a right not to smile", said attorney Jasmine Rand at a Thursday morning news conference in NY.

"They locked down the neighborhood and had us standing in the street". Prendergast plans to sue the Rialto police, but as of May 7, 2018, the information officer for the police said that while there was "pending legal action" it was unclear what that action would entail.

Police were responding to a 911 call from a neighbor who witnessed the women taking bags from the home and placing them in the vehicle. An attorney on Thursday called for an investigation into how police handled the situation and suggested the neighbor who called 911 should be investigated for filing a false report.

Kelly Fyffe-Marshall, one of Prendergast's friends, said seven police cars and a helicopter responded.

The neighbor reportedly called the police when the group did not return her wave as they left.

A group of black women said a golf course in Pennsylvania called the police after accusing them of playing too slowly. But in Prendergast's case, she was a victim of racial profiling by the neighbors who stayed near her Airbnb. "She then called the police", Fyffe-Marshall wrote. "I'm sad and irritated to see that fear is still the first place police officers go in their pursuit to serve and protect, to the point that protocol supersedes their ability to have discernment".

"I can not get into the caller's head, beyond that she thought she was seeing a crime", Hardin said. A neighbor across the street saw 3 black people packing luggage into their auto and assumed we were stealing from the house.

Later, Marley's granddaughter, Donisha Prendergast, expresses frustration that the matter isn't being cleared up faster and said they wouldn't have been reported if they were white.

"At no time during the encounter did officers use any form of restraints with the involved people and actually allowed them to exit their vehicle and assist officers in locating the owner of the unlicensed Airbnb", the release reads.

Airbnb previously said in a statement to CNN that what happened was "unconscionable and a reminder of how far we still have to go as a society".

New video released by police Tuesday provides more details into the incident that caused three black people to consider a lawsuit over what they say was an excessive response to a racially motivated 911 call in Southern California. They laugh together when they realize one officer is from Canada, like them, as they attempt to reach the homeowner of their Airbnb. Still, they say they have not ruled out future legal action. She added, "Strange vehicle, unusual people, in a suburban neighborhood, and they're not friendly".

Besheer asks her what race had to do with it.

"They had luggage in their hands and they weren't really looking at me", said the woman, who wasn't identified. "And I know the couple that own the house, and I didn't recognize them".

Komi-Oluwa Olafimihan, an artist, pointed out that "over 700 people that look just like me did not walk away alive from a situation like this a year ago".
