The repeal of "net neutrality" took effect six months after the Federal Communications Commission voted to undo the rules, which had barred broadband and cellphone companies from favoring their own services and discriminating against rivals such as Netflix.

"Internet service providers now have the power to block websites, throttle services and censor online content", Jessica Rosenworcel, a Democratic member of the commission who voted against the repeal, said in an emailed statement Monday.

While Congress recently voted to overturn the FCC's plan in the Senate, governors in New York, New Jersey, Montana, Rhode Island, Vermont, and Hawaii, have signed executive orders protecting net neutrality in their own states.

If the broadband providers do end up creating fast lanes - or even slowing or blocking traffic - they likely won't do so right away.

Lyons said he thinks the likelihood of actual harm from net neutrality is relatively remote, and that laws that already exist to regulate corporations, like anti-trust regulations, will prevent ISPs from behaving badly. Net neutrality rules which prevented broadband providers from discriminating against certain websites have been officially rolled back in the U.S., even as opposition groups fight to save the regulations.

Washington's net neutrality rule casts enforcement as a provision of consumer protection in an attempt to avoid stepping into federal telecommunications statutes.

The Internet Innovation Alliance, a coalition of business and non-profit organizations under leadership of Former Congressman Rick Boucher, D-Va., also defended the new laws.

The FCC is nearly certain to challenge Washington as the agency asserted preemption, in which federal laws have precedent over state ones. Its chairman has long argued against the rules, pointing out that before they were put into effect in 2015, service providers had not engaged in any of the practices the rules prohibited.

A group of 22 states have sued the FCC over the repeal. Such a scenario could be particularly devastating for startups with ambitions of becoming the next Netflix or Hulu, as they will have a much harder time paying ISP fees to compete early on.

In 2015, the FCC stripped the FTC - the nation's premier consumer protection agency - of its authority over internet service providers. "Democrats are fighting in the courts and in the Congress to protect Americans' interests and restore these vital protections, and we will continue to demand a vote on Congressman Mike Doyle's resolution to force a vote to restore net neutrality". More than 20 states have filed lawsuits to stop the repeal, and a number of states have pushed legislation to enforce net neutrality within its borders.
