The policies were introduced by Mr Trump's predecessor, Barack Obama, and outlined legal recommendations for institutions looking to consider race in applications as a way to boost diversity on campuses.

The new guidance, which discourages race-based admissions, will essentially reconstitute the approach the federal government took under George W. Bush.

The administration of U.S. President Donald Trump plans to revoke guidelines that encourage considering race in the college admissions process as a way of promoting diversity, it was reported Tuesday.

Harvard University's use of race in admissions has come under scrutiny in a federal lawsuit that alleges the school has discriminated against Asian-Americans. In a 2016 opinion written by Kennedy, the court granted affirmative action policies a victory by permitting race to be among the factors considered in the college admission process.

She said the Trump administration's move suggests that it doesn't favor racial diversity.

None of the three directives have any legal bearing on what colleges and universities may or may not choose to do with regards to affirmative action in admissions.

As it is wont to do, Jeff Sessions's Justice Department insists that its rejection of the Obama-era guidance has nothing to do with an ideological opposition to the substance of the policy.

The Justice Department in the Trump administration had already signaled its concern about the use of race in admissions decisions.

In an April court filing, siding with Blum's group, the Justice Department requested that Harvard disclose its records on its admissions practices publicly, a move that Harvard's attorney William Lee called "perplexing".

The guidelines, jointly issued by the education and justice departments under President Obama, encouraged universities to promote diversity on campuses.

Her former colleague, Anurima Bhargava, who was head of the department's civil rights enforcement under Obama, was cited by the paper as saying: 'The law on this hasn´t changed, and the Supreme Court has twice ruled reaffirming the importance of diversity'. That lawsuit in US District Court in Boston hinges on whether Harvard limits the number of Asian-American students it admits every year.

The high court has outlawed using racial quotas, but has allowed colleges and universities to continue considering race in admitting students.

The supreme court narrowly upheld the premise of race-based admissions 4-3 in the 2016 case of Fisher v Texas, but the decision is now vulnerable to being overturned with the impending retirement of Justice Anthony Kennedy.

"The Trump administration is sending precisely the wrong message to institutions that are committed to following four decades of Supreme Court precedent", said Ted Mitchell, president of the American Council on Education, a trade group that represents presidents of numerous country's colleges and universities. The change will reverse guidance issued by the Obama administration which recommended that schools consider race as one factor in admissions.
