Surveillance video in the parking lot of a Circle A Food Store shows Drejka arguing with 24-year-old Britany Jacobs, who was sitting in her parked vehicle, which was parked in a handicap space, ABC News reports.

While still on the ground, Drejka pulled out a gun and shot McGlockton in the chest, with a weapon he was legally carrying with a concealed carry permit.

Florida's "Stand Your Ground" law, which was enacted in 2005, allows residents to use force, including deadly force, if they "reasonably believe" they are at risk of death or great bodily harm.

According to the Tampa Bay Times, 47-year-old Michael Drejka will not be arrested for the shooting, although the State Attorney's Office will make a final determination.

Still, the Gualtieri told reporters, the legal question is not about whether Drejka was right in being the self-appointed protector of the handicap spot. His five-year-old son was reportedly inside the store and witnessed his mother applying pressure to his father's wounds. The shooting "is within the bookends of ‘stand your ground and within the bookends of force being justified", the sheriff said, later adding, "Im not saying I agree with it, but I dont make that call". "And it hurts so bad".

Gualtieri said the "stand your ground" law is clear and subjective and that this incident "is within the bookends" of the self-defense law, which was recently modified.

A representative from the state attorney's office did not immediately respond to a request for comment on Saturday.

The details to Thursdays incident are similar: Drejka walking around the truck checking for decals, then confronting Kelly, 31, about why he parked there.

Rich Kelly says the man picked a fight with him over a parking spot, using racial slurs, and even threatening to kill him.

"It's a repeat. It happened to me the first time".
