Attorneys for the disgraced film mogul filed a motion for dismissal in NY federal court Friday, citing, among other things, the discovery of evidence that the grand jury was not shown - specifically "dozens of emails" sent from one of Weinstein's anonymous accusers, characterized as "extensive warm, complimentary and solicitous messages to Mr. Weinstein immediately following the now claimed event and over the next four year period".

The disgraced producer is charged with six sexual assault counts relating to three different women, including predatory sexual assault, criminal sexual act in the first degree, and rape in the first and third degrees.

Ben Brafman, one of America's most celebrated defence attorneys who helped former International Monetary Fund boss Dominique Strauss-Kahn escape criminal prosecution for alleged sexual assault in 2011, called for the entire indictment against Weinstein to be dismissed, based on the emails and a barrage of technicalities.

He was released on bail and pleaded not guilty to the charges allegedly committed against in 2004, 2006 and 2013.

Harvey Weinstein says there are around 40 emails that will show he didn't rape one of his accusers.

Court filings obtained by the Los Angeles Times contained emails between Weinstein and an unidentified woman in 2013 in which the woman states that "it would be great to see you again" in one message dated after an alleged instance of rape.

The filing, a copy of which was uploaded to document-sharing website Scribd, shows that Weinstein's lawyers sought an emergency phone conference with the court prior to 4 p.m. Thursday.

"These communications irrefutably reflect the true nature of this consensual intimate friendship, which never at any time included a forcible rape", Weinstein's attorney, Ben Brafman told CNN in a statement.

Weinstein is next due to appear in court on September 20. "There is no one else I would enjoy catching up with that understands me quite like you", she purportedly wrote to Weinstein in July 2014. Just had u cross my mind and thought u would send a hello. "But thank you that makes me so happy to hear".

When Weinstein apparently replied: "Love to cross your mind it's my favorite exercise", she answered: "Lol that made me laugh so hard".

The defense lawyer accused Manhattan District Attorney Cyrus Vance of acting in haste, caving under "unprecedented" pressure to indict Weinstein, having been investigated for failing to prosecute him for an alleged groping incident in 2015.

"It is Mr. Weinstein's belief that these e-mails are material and exculpatory and the failure of the district attorney to provide this evidence to the grand jury warrants a dismissal of the indictment".

The accusations against Weinstein led to the #MeToo movement in which hundreds of women publicly accuse powerful men in business, politics and entertainment of sexual harassment and abuse.
