HARARE | Emmerson Mnangagwa (75) of Zanu-PF has officially been declared as the elected President of The Republic of Zimbabwe after the country's Constitutional Court (ConCourt), through Chief Justice Luke Malaba and 8 other judges, upheld results announced by the Zimbabwe Electoral Commission (ZEC) early this month declaring the ruling party's candidate as victor of elections held on 30 July, 2018.

Nine judges, led by Chief Justice Malaba, delivered the unanimous verdict at the court in Harare, amid tight security though there were no protests ahead of the ruling.

The top jurist said Chamisa failed to "provide clear, direct, sufficient, and credible reasons" that the alleged reasons cited marred the poll.

Nelson Chamisa is a Zimbabwean politician who is now the President of a faction of the MDC-T and leader of the MDC Alliance.

A spokesman for Zimbabwe's ruling party says the inauguration of President Emmerson Mnangagwa will be on Sunday after the constitutional court upheld his election win.

The legal challenge delayed Mnangagwa's planned inauguration for August 12.

The main opposition Movement for Democratic Change Alliance took the results of the election to the constitutional court alleging that the president (first respondent) had benefitted from irregularities in the voting process.

In presenting their submissions before the court, Mnangagwa's legal team argued that the justices had to dismiss the application because it lacked merit and could not warrant invalidation of the poll results.

"The best evidence would have been the contents of the ballot boxes themselves", he said. "The applicant is clearly flippant", he said.

The iron-fisted president had been the only leader Zimbabwe had known in almost four decades of independence - that is, until he stepped down late a year ago under pressure from the military and Mnangagwa, an erstwhile ally who had served as Mugabe's spymaster before the two had a falling out.

"The outcome is pretty predictable", Matyszak told AFP.

Global monitors largely praised the conduct of the election itself, although European Union observers said that Mnangagwa, a former long-time Mugabe ally, benefited from an "un-level playing field".

"It is not for the court to decide elections, it is the duty of the people ..." The ceremony could happen in the next 48 hours.
