The administration told the appeals court last month that if it didn't rule by October 31, the government would go directly to the Supreme Court to seek resolution during the current nine-month term.

The US Supreme Court has declined to hear the broadband industry's challenge of Obama-era net neutrality rules.

Chief Justice John Roberts and Justice Brett Kavanaugh recused themselves from the case. Justices Clarence Thomas, Samuel Alito and Neil Gorsuch indicated that they would have opted for Munsingwear vacatur, which would have left the D.C. Circuit's ruling without any precedential value. Four of nine justices must agree to hear a case, but only three voted to grant the petitions. Providers complained that the rules were overly burdensome and a violation of the FCC's congressionally granted powers; consumer advocates said the rules were necessary as a vital consumer protection.

Still, the high court's rejection preserves the appeals court's decision as a possible precedent and makes it even more likely that the issue will resurface if the FCC shifts its makeup - something that would happen if Democrats are able to win back the White House in 2020.

The U.S. Supreme Court has decided not to review a challenge made by the telecom industry against the original rules for net neutrality that were decided on during the Obama-era.

The FCC's rescission of the net neutrality rule came after Republicans, led by Chairman Ajit Pai, took control of the agency previous year. "The ISPs went all out to push FCC Chairman Ajit Pai to repeal the agency's net neutrality rules - and then ran to the Supreme Court looking for a do-over on earlier cases that rightly upheld those rules".

She added, "Let's call this interesting".

United States Telecom Association (USTelecom) president and CEO Jonathan Spalter, echoed that the SCOTUS's vote was expected, as the FCC's more recent Restoring Internet Freedom Order "remains the law of the land…USTelecom will continue to support that order from challenges in Washington, D.C. and state capitals".

The FCC's repeal of net neutrality is also the subject of separate legal battles, after it was challenged by tech companies and advocacy groups, in addition to more than 20 USA states.
