Mr Sessions, who was an early backer of the Trump campaign, recused himself in March 2017 from overseeing the Russian Federation investigation under a similar rule which prohibits officials from overseeing investigations into subjects with whom they have a "a personal or political relationship". Trump said a permanent replacement will be nominated at a later date.

Whitaker, in a Justice Department statement released on Wednesday evening said, "I am committed to leading a fair department with the highest ethical standards, that upholds the rule of law, and seeks justice for all Americans".

Democratic Representative Jerrold Nadler, who is in line to become chairman of the House Judiciary Committee in January, said it is "wholly inappropriate" for Whitaker to take over the Mueller probe and that Rosenstein should continue overseeing it.

He said there are only three ways someone can become acting attorney general: if they are the deputy attorney general and the president signs an executive order to make them acting attorney general, if they are already at the Justice Department in a job that both required and received Senate confirmation or if the Senate in in recess, they can be a recess appointment.

Florida attorney general Pam Bondi, who has appeared with Trump at campaign events, has also been floated.

Trump's relationship with Sessions frayed just weeks into his tenure, when he stepped aside from the Russian Federation investigation. He also obtained indictments against Russian individuals and companies accused of a sweeping conspiracy to hurt Democrat Hillary Clinton and ultimately to help Trump win.

"Why is the President making this change and who has authority over Special Counsel Mueller's investigation?"

Mr Trump has vehemently denied any collusion took place, and repeatedly called for the inquiry to be shut down, calling it "the greatest political witch hunt in history".

"It is imperative that the Administration not impede the Mueller investigation", she tweeted.

Yet when Sessions got the boot on Wednesday ― his letter said he resigned at the president's request ― Graham offered a different message. Nobody Is Above The Law said it wants Whitaker to recuse himself from supervising the investigation.

If Mr Whitaker chose to fire Mueller, he would need to inform the special counsel in writing of the specific reason for his termination. And he's one step closer to being able to do just that.

He also said there was no real evidence to support allegations Trump obstructed justice, and in an opinion article for The Hill newspaper he said Trump made the "right decision" by firing FBI Director James Comey in 2017. "Donald Trump acted while we were still embroiled in midterm elections because he wanted to catch us off guard".

"Donald Trump may think he has the power to hire and fire whomever he pleases, but he can not take such action if it is determined that it is for the purposes of subverting the rule of law and obstructing justice", said the congressman.
