After Judge Brings Up Treason, Will Michael Flynn Be Getting Jail Time?

After Judge Brings Up Treason, Will Michael Flynn Be Getting Jail Time?”

"This judge don't play", said Rangappa, who earlier on Tuesday smacked down the conspiracy theory claiming Flynn had been forced to lie to the Federal Bureau of Investigation.

Sullivan said: "I can not recall any incident in which the court has accepted a plea of guilty from someone who maintained he was not guilty and I don't intend to start today". He can push to have Sullivan recused, cooperate more with the prosecution, or ask that Sullivan throw out his "questionable" guilty plea.

Pavlich insisted that the judge "knows" that the case before him is "one of the most high-profile cases that has been in the public atmosphere in a very long time".

Flynn will be sentenced in 2019 for making false statements to the FBI about his contact with Russian officials, which is central to the investigation into claims of Moscow collusion in the 2016 election being carried out by special counsel Robert Mueller. The hearing upset what had been a carefully crafted agreement and pushed months into the future a resolution of one of Mueller's signature prosecutions.

"Arguably this undermines everything this flag over here stands for", he added, pointing to a nearby flag in the courtroom. He also backpedaled on an earlier question on whether Flynn's transgressions amounted to treason, saying he didn't mean to suggest they did.

Flynn took the legs out of some of President Donald Trump's most recent attacks on the Russian Federation investigation.

Flynn has three options, but all can backfire, warned Dershowitz.

It all comes amid escalating legal peril for Trump, who was implicated by federal prosecutors in NY this month in hush-money payments involving his former lawyer to cover up extramarital affairs. Almost a half-dozen former aides and advisers have pleaded guilty, agreeing to cooperate with prosecutors. Some, like Flynn, have been tripped up by concealing Russian contacts.

Flynn has been a central focus of the Mueller probe.

"The FBI broke standard protocol in the way they came in and ambushed General Flynn and in the way they questioned him", she said. "There was no Collusion!" But he may have wished to avoid prosecution on other charges, including the crime of failing to file as a foreign agent for Turkey, for which two of his business partners were indicted on Monday. Of Trump's earlier criticism of the agency, she said, "We don't have any reason to want to walk that back".

Prosecutors hadn't recommended prison, but the hearing that began with the defendant upbeat and smiling took an unexpected turn when the judge said his sentence would take into account not just Flynn's extensive cooperation with investigators but also the lies the Trump administration official told from the grounds of the White House.

But that job soon brought him trouble: Transition-period calls with then-Russian Ambassador Sergey Kislyak raised intelligence community alarms even before Trump took office.

The agents asked Flynn if he discussed the United Nations vote regarding Israeli settlements with Kislyak.

A February 2017 report and document, which the Federal Bureau of Investigation calls a "302", shows that when Federal Bureau of Investigation agents questioned Flynn, they were well equipped with information about Flynn's communications with Kislyak.

But Sullivan made clear Tuesday that he didn't buy that argument. He acknowledged that he indeed knew that lying to the Federal Bureau of Investigation was a crime and neither he nor his lawyers disputed that he had lied to agent.

Attorneys for Flynn asked the judge to postpone the sentencing.

He gave Flynn a chance to talk it over with his lawyers, and the court went into a brief recess.

When they returned, Kelner requested a postponement so that Flynn could keep cooperating.

The delay allows Flynn to continue cooperating with the special counsel's Russian Federation probe and get credit for it in his punishment. Flynn left the courthouse hand-in-hand with his wife, climbing into a large SUV as protesters heckled and supporters chanted "USA!"
