Sen. Durbin: ‘The Republicans have no alternative to the Affordable Care Act’”

The Affordable Care Act was gutted by a Texas federal judge in a ruling that casts uncertainty on insurance coverage for millions of US residents.

The states challenging the law were led by Texas Attorney General Ken Paxton and Wisconsin Attorney General Brad Schimel, both Republicans.

U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of Republican states led by Texas that he had to eviscerate the Affordable Care Act, the signature health care overhaul by President Barack Obama, after Congress a year ago zeroed out a key provision - the tax penalty for not complying with the requirement to buy insurance.

Democratic lawmakers hit back against a federal of 19 states that argued several key provisions of the Affordable Care Act, or "Obamacare", are unconstitutional.

"Wow, but not surprisingly, ObamaCare was just ruled UNCONSTITUTIONAL by a highly respected judge in Texas".

Schumer, the Senate minority leader, said Sunday that he is going to renew an effort to force a vote on getting the chamber to go to court in defense of the health care law.

Repealing and replacing Obamacare was Trump's election promise and he has been working on this in the first two years of his administration. That latter group will also include many Republicans who campaigned on the promise to protect people with pre-existing conditions and could face political consequences if they renege on that. "Mitch and Nancy, get it done!"

The 2012 case was over whether such a penalty was legal - but now that it is gone, O'Connor says the whole Affordable Care Act should be stricken down because that provision is "the keystone" of the program.

The opposition Democrats were quick to raise their voice against the ruling by the federal district judge.

"This is a backward, poorly-reasoned decision, but it does not change the fact that the Affordable Care Act is still the law of the land", Mills said in a statement Saturday. Without the ACA, 52 million Americans under 65 could see their insurance at risk due to a preexisting condition, according to a 2016 analysis from the Kaiser Family Foundation.

Mr Trump, writing on Twitter, called the Texas ruling "Great news for America!" and said Obamacare was an "unconstitutional disaster".

Conservative Republicans have long opposed the plan, signed into law by president Barack Obama in 2010.

Becerra called Friday's ruling "an assault on 133 million Americans with pre-existing conditions, on the 20 million Americans who rely on the ACA's consumer protections for health care, on America's faithful progress toward affordable health care for all Americans".

Judge O'Connor breezes past this like a liberal Ninth Circuit appeals judge handling a Donald Trump appeal.

Indiana Attorney General Curtis Hill signed Indiana onto the lawsuit.

"There's no reason why the individual mandate provision can't be struck down and keep all the good provisions of the Affordable Care Act", Collins said of the bill that Republicans have decried since its 2009 passing, and that she initially voted against but recently voted to save. Currently, about 10 million have subsidized private insurance through the health law's insurance markets, while an estimated 12 million low-income people are covered through its Medicaid expansion.
