Ferguson said he will be seeking a temporary injunction to prevent the rule from taking effect until the case - which he said he expects to win - is decided. "This gag rule is unethical and unconscionable".

One of those statutes involves language added to the spending bill that funded HHS in 1995 and was renewed in subsequent years.

Another provision that drew praise from Archbishop Naumann is its prohibition on referrals for abortion as a method of family planning.

Leah Litman, an assistant professor of law at the University of California, Irvine, said the now more conservative Supreme Court might not necessarily accept those arguments, as well as others likely to be raised. Eastern Washington has 20 counties, 11 of which would be left without Title X providers, he said.

The Title X changes - slated to take effect in two months - are created to address several concerns among Trump administration officials, including that the current rules are not sufficient to protect against commingling of the restricted funds and those that can be used for abortion services.
