NY Senate passes bills on Trump's tax returns and pardon power”

State Democrats are hopeful the legislation will present a way around the president's refusal to turn over his financial information.

The action in albany comes amid a standoff in Congress over documents, including Trump's tax returns.

White House officials didn't respond to a request for comment.

State Sen. Brad Hoylman, who sponsored the bill, told CBSN in April that the bill was a response to the administration's "stonewalling" of congressional requests to provide Mr. Trump's federal tax returns.

"People are sick of this stuff, they're sick of the investigations, they're sick of everybody fighting with each other, they're sick of the politics on both sides ー Democrats and Republicans", he said. "Lo and behold, we have Donald Trump's tax returns here in the state of NY and we can provide them to Congress if the IRS, if the Treasury Department won't".

The bill must still pass the Assembly, but that's a done deal as Democrats outnumber Republicans in that chamber by more than 2-1.

Federal law allows Congress to demand the president's tax returns under certain circumstances, but on Monday Treasury Secretary Steven Mnuchin declined to disclose Trump's federal returns to the Democratic-controlled House, saying the request "lacks a legitimate legislative goal".

That refusal set the stage for a possible legal battle.

On Tuesday, the New York Times published a report that Trump declared business losses of $1.17 billion between 1985 and 1994. The bill has been voted out of committee, but has not gotten a vote in either chamber.

As President Donald Trump continues to refuse requests from Democrats on Capitol Hill to hand over copies of his tax returns, state lawmakers in NY are ramping up their efforts to obtain them.

The proposed measure to raise the state sales tax in order to cut property tax rates is now a dead letter.

Gov. Andrew Cuomo, a Democrat, has said he supports legislation allowing the president's tax returns to be made public, but only if it also applies to all state lawmakers and statewide elected officials in NY. The state Senate also passed a bill, in a 39-22 vote, that would allow NY to prosecute people who received presidential pardons if certain conditions are met. The bill was crafted to eliminate an unintended loophole in the state's double jeopardy law that prosecutors say could undermine New York's ability to prosecute anyone pardoned by Trump.

The state Assembly has not scheduled a vote on the bill.
